These Terms of Use ("Terms") govern your access to and use of the website of Fun Sized Enterprises, LLC d/b/a Sunshine Aesthetics Med Spa ("Sunshine Aesthetics," "Company," "we," "us," or "our"), located at sunshinemedspa.com, and any services, appointments, memberships, or treatments you request or receive from us.

Please read these Terms carefully. They include a binding individual arbitration provision, a class-action waiver, and a one-year limitations period in Section 14, which affect how disputes between you and us are resolved.

By accessing or using this website, requesting information, submitting a form, booking an appointment, purchasing a membership or package, or receiving any treatment or service from us, you agree to these Terms. If you do not agree, please do not use this website or our services.

These Terms govern your use of this website. If you receive services from us, you will also sign our Company Policies, Release and Waiver of Liability, Media Consent & Release, and any treatment-specific informed consents. Those signed documents govern your treatment relationship, and where they and these Terms both apply, Section 21 governs which controls.

1. No medical advice; no provider–patient relationship through this website

The content on this website — including descriptions of treatments, concerns, before-and-after images, and any educational material — is provided for general informational purposes only. It is not medical advice, and it is not a substitute for consultation with a qualified healthcare provider.

Using this website, submitting a form, or corresponding with us does not create a provider–patient relationship. A provider–patient relationship is established only after an in-person consultation and intake at our facility, completion of any required Good Faith Exam, and acceptance of you as a client by a licensed provider.

Do not rely on anything on this website to diagnose or treat a condition, and do not delay seeking professional medical advice because of something you read here. We do not provide emergency medical services. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Do not use this website, our contact form, or text messages to communicate an emergency.

2. Eligibility

Website use and online booking. You must be at least 18 years of age to use this website, book an appointment online, or purchase services through this website.

Treatment of minors. Our minimum age for treatment is 14. Clients aged 14 to 17 are eligible for facials only. No other service — including chemical peels, laser treatments, microneedling, and injectables — is available to clients under 18. Treatment of a minor requires the consent and signature of a parent or legal guardian on our intake and consent documents, and remains subject to a licensed provider determining the service is appropriate. Minors may not book online or enroll in a membership.

Memberships. Membership enrollment requires that you be at least 21 years of age, as set out in the Membership Agreement.

Certain treatments carry additional age, health, pregnancy, medication, or contraindication requirements, which are assessed at consultation.

3. Consultations, appointments, intake, and Good Faith Exam

All treatments require a consultation and completion of an intake and informed-consent form before service. You agree to provide complete and accurate health information, including medications, supplements, allergies, prior procedures, and relevant medical history. Withholding or misstating this information may make a treatment unsafe. Failure to provide accurate or complete information may release us from liability for resulting adverse outcomes, as set out in our Company Policies.

Prior to receiving certain treatments you may be required to complete a Good Faith Exam, as determined by applicable law and our protocols. Completion of the Good Faith Exam is a condition precedent to receiving treatment. A valid card on file is required to schedule it. Failure to attend, to timely reschedule, or to respond to outreach regarding completion may result in cancellation of the associated treatment appointment, and we may decline to reschedule or provide future appointments.

We reserve the right to decline or discontinue any treatment where, in the judgment of our licensed staff, it is not appropriate or not safe for you. We may also suspend or terminate the client relationship where a client fails to comply with our policies or medical instructions, engages in abusive, harassing or threatening behavior, or misuses medications or violates applicable law.

You are required to follow all pre- and post-procedure instructions provided by your provider. Failure to comply may lead to suboptimal outcomes for which we are not responsible.

4. Booking, payment, cancellations, late arrival, and no-shows

A valid credit card on file is required to hold all reservations. By providing your card information you authorize us to charge it for outstanding balances, late-cancellation fees, and no-show fees. You are responsible for ensuring an accepted form of payment is available at the time of your appointment; failure to provide payment at time of service may result in cancellation of the appointment and refusal of future services until the balance is resolved.

Full payment is due at time of service, including consultation fees, unless an approved payment plan is in place. We accept cash, major debit and credit cards, and personal checks, subject to a $35 returned check fee.

  • Cancellations and reschedules require a minimum of 24 hours' notice. Changes made within 24 hours of your appointment incur a $50 fee.
  • Failure to appear for a scheduled appointment results in a $50 no-show fee.
  • We offer a 15-minute grace period for late arrivals. Arrival more than 15 minutes after your scheduled time will require rescheduling or cancellation, at our discretion, and incurs a $50 fee.
  • Appointments booked with less than 24 hours' notice require prepayment in full at time of booking.
  • All cancellation and no-show fees are non-refundable and cannot be applied toward future services.

Online booking and consultation scheduling are provided through a third-party system (PatientNow). Information you enter there is handled under that provider's terms, our Notice of Privacy Practices, and our Privacy Policy.

5. Results, refunds, and dissatisfaction

Aesthetic treatment outcomes vary from person to person and depend on skin type, physiology, age, health, adherence to pre- and post-care instructions, and factors outside anyone's control. We do not guarantee any particular result, and no statement on this website is a promise or warranty of outcome. Treatments may require multiple sessions, maintenance, or a series to achieve or sustain results, and a series purchased is not a guarantee of a stated outcome.

All services are non-refundable. We do not issue refunds based on general dissatisfaction. Because aesthetic services are individualized and cannot be reversed once administered, all filler and other treatment sales are final.

All adverse reactions and dissatisfaction-related requests must be documented in writing to us within fourteen (14) business days of treatment. For this purpose, "documented" means a photo or video, in proper lighting, that clearly depicts the reaction or condition.

We do not offer cash or card refunds on products. Unused and unopened products may be returned within 7 days for in-spa credit. Defective products may be exchanged for the same item within 7 days. For provider-recommended products purchased from third-party vendors, you are responsible for all costs, taxes, and shipping, and the vendor's return and refund policies govern.

Before-and-after images on this website are published only under a signed Media Consent & Release. Clients may revoke that authorization in writing at any time as to future use; revocation does not affect images already published in reliance on the authorization. Individual results will differ.

6. Treatment packages

Treatment packages must be paid in full at the first session. Treatment packages do not expire. Unused sessions are non-refundable.

7. Gift cards and credits

Gift cards issued by us are non-refundable and not redeemable for cash, except where required by law, and may be applied toward eligible services. Lost or stolen gift cards will not be replaced. Gift cards must be presented at the time of use. Any credits we issue expire one (1) year after issuance.

8. Memberships

Memberships are recurring monthly programs governed by our Membership Agreement & Terms of Service, which you sign at enrollment. That signed agreement controls your membership; the summary below is provided for convenience only and does not modify it. Membership plan details, pricing, and included benefits are set out in Exhibit A to that agreement.

  • Term. Membership begins on the date you sign and continues for an initial commitment period of three (3) months, then automatically continues month-to-month until cancelled.
  • Billing. Monthly fees are billed in advance on the first day of each calendar month. You must maintain a valid credit or debit card on file and you authorize us to charge it automatically. All payments are final and nonrefundable. Monthly payments are not held in a trust or bank account and do not create a refundable balance.
  • Cancellation. Cancellation requires written notice at least thirty (30) days before your next scheduled billing date, sent to memberships@sunshinemedspa.com, and takes effect on the last day of the then-current paid month following expiration of the notice period.
  • Early termination. Cancelling before the initial three-month term completes is treated as early termination and incurs an early termination fee equal to the total discounts you received under the membership.
  • Monthly benefits do not roll over. The included monthly skincare service and the Glow Wallet Credit must be used within the calendar month in which they are issued and are forfeited if unused. The Glow Wallet Credit is not cash, stored value, a gift card, a deposit, or a refundable balance, is not exchangeable for cash, and may not be combined with tier-based percentage savings or other promotional offers.
  • Non-transferable. Membership and all member benefits are personal to you and may not be shared, pooled, assigned, transferred, sold, or gifted. The sole exception is the Guest Pass, which is expressly intended for use by an eligible new client on the terms set out in Exhibit A.
  • No freezes. Memberships may not be frozen, paused, or suspended for any reason. Your options are to maintain the membership in active status or to cancel it as described above.
  • Good standing. Member benefits, pricing, and discounts apply only while the membership is active and in good standing. If a payment is declined you must provide updated payment information within five (5) days; benefits may be suspended while a balance is outstanding, and a balance unpaid for more than thirty (30) days may result in the membership being deemed cancelled.
  • No guarantee of treatment. Enrollment does not guarantee that any particular treatment, service, provider, or appointment time will be available or appropriate. All services remain subject to medical evaluation and provider judgment.
  • Not insurance. Our services are elective aesthetic services and are not billed to insurance. You remain responsible for all membership fees and treatment costs regardless of any insurance coverage.

Enrollment requires that you be at least 21 years of age, as represented in the Membership Agreement.

9. Referral program

Under our referral program, when you refer someone who is a first-time client of Sunshine Aesthetics and that person completes a paid service, you and the person you referred each receive a $50 credit.

  • First-time clients only. The person referred must not be a current or former client of Sunshine Aesthetics.
  • Earned on a completed paid service. Credits are issued after the referred person completes and pays for a service. A booked, cancelled, or no-show appointment does not qualify, and a service received at no charge does not qualify.
  • Expiration. Referral credits expire one (1) year after issuance, consistent with our general credit policy.
  • No stacking. Referral credits may not be combined with each other or with other discounts, promotional rates, or offers on the same transaction.
  • Service credit only. Referral credits are applied toward eligible services, are not redeemable for cash, and are non-transferable.

We may modify or discontinue the referral program at any time. Credits already earned will be honored in accordance with these terms.

If we choose to honor a credit or make an accommodation outside these terms in an individual case, that is done at our sole discretion and does not waive these terms or create any entitlement for any other person or occasion.

10. Pricing

Prices displayed on this website or quoted in consultation are subject to change and are not guaranteed until service is rendered or a package is purchased. Quoted treatment plans may change following consultation, where the appropriate treatment or number of sessions differs from an initial estimate.

11. Health information and privacy

We are required by federal and state law to maintain the privacy of your health information. Our Notice of Privacy Practices, effective March 1, 2026, describes how we may use and disclose your health information and your rights concerning it, and takes precedence over this Section as to protected health information. Our website Privacy Policy and Cookie Policy describe information collected through this website.

Please note an important distinction: forms on this website, and ordinary email and text messages, are not secure channels and are not a patient portal. Do not transmit detailed health information, photographs of a medical condition, or other sensitive information through the website contact form, email, or SMS. Clinical information should be provided at your appointment or through any secure channel we designate.

Information you submit through the contact and referral forms on this website is transmitted to and processed by a third-party form service (Formspree). Information submitted through booking or consultation scheduling is processed by PatientNow. Information submitted to our newsletter signup is processed by MailerLite.

12. Third-party services, vendors, and links

This website uses third-party services for booking, forms, email, and analytics, and may link to third-party websites. We do not control those services or sites and are not responsible for their content, practices, or terms. Your use of a third-party service is governed by that party's terms and privacy policy.

We may use artificial intelligence technologies and third-party vendors in the course of our business operations, including for communications, scheduling, client relationship management, marketing, and data processing. Clients who sign our Release and Waiver of Liability consent to this as set out in that document's Artificial Intelligence Waiver and Consent. We employ reasonable and industry-standard measures to safeguard information, but no system is entirely secure or error-free.

13. Disclaimers, limitation of liability, and indemnification

This website is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the website will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, Sunshine Aesthetics and its owners, members, employees, contractors, and agents (the "Released Parties") will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of this website.

Release as to website use. To the fullest extent permitted by law, you release and forever discharge the Released Parties from any and all claims you may have or hereafter have arising out of or relating to your access to or use of this website, including any collection, use, or transmission of information through it.

Indemnification. You agree to defend, indemnify, and hold harmless the Released Parties from and against any losses, damages, actions, suits, claims, judgments, settlements, awards, interest, penalties, expenses (including reasonable attorneys' fees), and costs of any kind arising out of your breach of these Terms or your misuse of this website.

One-year limitations period. Any claim arising out of or relating to these Terms or this website must be brought within one (1) year as set out in Section 14.

If you are a client who has signed our Release and Waiver of Liability, that document's provisions also apply and are not modified or narrowed by these Terms.

Nothing in this Section limits or excludes liability for death or personal injury, for gross negligence or willful misconduct, or for any liability that cannot be limited under Florida law. Claims arising from the provision of treatment are not governed or limited by this Section; they are governed by our signed Release and Waiver of Liability and by applicable Florida law, including any applicable medical-malpractice provisions. Some states do not allow certain limitations, so parts of this Section may not apply to you.

14. Dispute resolution; individual arbitration; class-action waiver

Please read this Section carefully. It affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.

Good-faith resolution first. The parties will first attempt in good faith to resolve any dispute within thirty (30) days after written notice.

Thereafter, except for claims within small-claims jurisdiction and except for injunctive relief to protect confidential information or intellectual property, any dispute arising out of or relating to these Terms, this website, or our services shall be resolved by confidential, binding arbitration before a single arbitrator in Alachua County, Florida, administered by a recognized arbitral forum. The arbitrator may award any relief a court could award, subject to the limitations in these Terms.

"Dispute" shall be interpreted broadly and includes any claim or controversy arising out of or relating in any way to your relationship with Sunshine Aesthetics — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory. This includes, without limitation: (1) your access to or use of this website, including any collection, use, or transmission of information through it; (2) consultations, appointments, treatments, and services; (3) memberships, packages, series, gift cards, and the referral program; (4) any of our terms or policies; and (5) our advertising, marketing, and sales practices.

By agreeing to arbitration, you understand and agree that you are waiving your right to maintain other available resolution processes, such as a court action or administrative proceeding. The rules in arbitration are different: no judge or jury, less discovery, and limited appellate review.

Disputes must be brought in an individual capacity and not as a class, collective, or representative action. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.

One-year limitations period. Any claim arising out of or relating to these Terms, this website, or our services must be filed within one (1) year after the event giving rise to the claim, or it is forever barred, to the fullest extent permitted by law.

If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial, unless such waiver is unenforceable. This means that any claim would be decided by a judge, not a jury.

15. Applicable law and venue

These Terms will be governed by and interpreted in accordance with the laws of the State of Florida, without giving effect to its principles of conflicts of law, and by the Federal Arbitration Act as to Section 14. For any matter not subject to arbitration, you agree that any action must be brought exclusively in a state or federal court located in Alachua County, Florida.

16. Non-disparagement and recording

Our Company Policies include non-disparagement and recording/social-media provisions that apply to clients who sign them.

17. Intellectual property

All content on this website — text, images, before-and-after photography, logos, trade names, and design — is owned by Sunshine Aesthetics or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, republish, or use it for commercial purposes without our written permission. Media Files created at our facility are our property as set out in the Media Consent & Release. Product and treatment names referenced on this site are trademarks of their respective owners and are used to identify the services we provide.

18. Text messages and email

Our SMS program is governed by our separate SMS Terms, which remain in effect and are incorporated here by reference. Message and data rates may apply. You may opt out of marketing email at any time using the unsubscribe link in any such message.

19. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision, and material changes will be posted on this page. Our Company Policies are also subject to change, and the most current version is made available at our facility and published on our website.

20. Severability

If any provision of these Terms is held illegal, invalid, or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full force and effect.

21. Relationship to our signed client documents

If you receive services from us, you will sign our Company Policies, Release and Waiver of Liability, Media Consent & Release, and any treatment-specific informed consents. Those documents govern your treatment relationship with us. These Terms govern your use of this website.

These Terms are among the posted Company Policies incorporated by reference into our Release and Waiver of Liability. Where these Terms and a signed document both address the same subject and conflict, the signed document controls as to your treatment relationship, and these Terms control as to your use of this website.
